In an interview with the House Democratic leader Nancy Pelosi said that Republicans will “rue the day” if the Supreme Court “buys their arguments” and invalidates tax subsidies for millions of people under President Barack Obama’s health care law.

2 things:

1. “Rue the day” , Really? who says that? We at Game Changer PAC appreciate the works of Shakespeare as much as anyone -Especially MACBETH, wherein this phrase was made famous-, but for someone that complains about their opposition being out of touch all the time, You really need to work on your choice of idioms, Ms. Pelosi.

2. Republicans won’t “Rue the day” the SCOTUS knocks down something because the SCOTUS doesn’t answer to any one political party, as much as you wish they would.  Supreme Court Justices are appointed for life specifically to grant them the ability to make rulings, based on the Constitutionality of a law or action, or to decide a case that resulted in a Circuit Split -as is the issue with this case-, without regard to how it will make the ruling class feel about it.  And it allows them the ability to make those decisions without the possibility of political pressure being applied or the threat of being replaced if they don’t side with what ever party is currently in power.

Republicans have ZERO control over how the Supreme Court rules on a case.  And the Republican Party didn’t bring the case.  So the ruling will not cause them to “Rue” anything, unless you and your friends start telling some MASSIVE lies -and you will try, we all know you will try.

The case we are talking about is King v. Burwell which is challenging the ability for federal government, via U.S. Treasury regulation, 26 C.F.R. § 1.36B-2(a)(1) , to provide tax subsidies to those have signed up for the Patient Protection and Affordable Care Act (ObamaCare) on the FEDERAL EXCHANGE. The text of  the law passed by congress clearly states that subsidies are only available to those that signed up on a STATE EXCHANGE. However, those that signed up on the FEDERAL EXCHANGE were also given the same subsidies.

Section 1401 of the ACA says tax credits are available only to those who enroll in qualified health plans “through an Exchange established by the State under Section 1311.” In fact the exact text “through an Exchange established by the State under Section 1311.” appears in the enacted legislation 9 times.

But we understand if Fmr. Speaker Pelosi didn’t know that.  After all, she was the one that said “we have to pass the bill so that we can find out what’s in it.”

So, Nancy, the question becomes: Will the Republicans “Rue the day” because they want the text of the law -that you fought so hard for- to be followed?

Or will Democrats “Rue the day” because they violated the law -that they wrote- in order to illegally give billions of dollars in subsidies to people, only to have those subsidies taken away, because the leader of your party violated the constitutionally written separation of powers in unilaterally changing that law, because he knew that the law -as written- would hurt his chances for re-election in 2012 -only to have the fact that he did violate the constitution come out as the 2016 Presidential elections start ramping up?

And now, if those subsidies are struck down by the supreme court and millions of people are put in financial hardship due to the law that you wanted to get passed before anyone had a chance to read it, that was unconstitutionally altered: do you really think that when the Republicans show themselves to the American People as attempting to fix the problems and financial hardships -caused by the Democrats-, it will hurt them?

Republicans have said they will try to ensure people don’t lose insurance if the high court rules this summer against tax subsidies for health care coverage in certain states.

Nancy, this is something -that if handled correctly- will help Republicans, not hurt them.   And Democrats will “Rue the day” they decided to violate the Constitution without regard to how much it would hurt the American People.
